Introduction
These Terms of Service (“Terms”) govern your access to and use of the Roll & Dine website, mobile applications, and related services (collectively, the “Services”). The Services are operated by
Roll & Dine (“we,” “us,” “our”).
Roll & Dine is operated by
Yevgeniy Kashkin (sole proprietor registered in British Columbia, Canada).
By accessing or using the Services, you agree to these Terms and to our
Privacy Policy and
Cookies Policy. If you do not agree, do not use the Services.
We may update these Terms from time to time. Material changes will be posted with an updated effective date. Changes will apply on a forward-looking basis unless otherwise required by law.
What we are
Roll & Dine provides a
technology platform that enables users to browse menus, place orders, and pay for food and related items offered by independent third-party providers (such as restaurants, kitchens, home cooks, vendors, and/or delivery couriers) (collectively, “Third-Party Providers”).
- We do not prepare food. Food preparation and labeling are the responsibility of the Third-Party Provider.
- We do not guarantee delivery services. Delivery (if available) may be performed by Third-Party Providers and/or independent couriers.
- We are not the seller of Third-Party Provider items. Unless explicitly stated otherwise, the Third-Party Provider is the merchant of record for the items you purchase.
Eligibility
By using the Services, you represent and warrant that:
- You are at least 18 years old and can form a binding contract.
- You will comply with applicable laws and regulations.
- You are not prohibited from using the Services under applicable sanctions, export controls, or other laws.
If you do not meet these requirements, you must not use the Services.
Accounts and security
- You may need an account to use certain features (e.g., ordering, saving addresses, viewing order history).
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and keep your account information up to date.
- We may suspend or restrict access if we suspect unauthorized access, fraud, or security issues.
Orders, pricing, and payments
Placing orders
- When you place an order, you agree to pay the listed price, applicable taxes, and any additional fees disclosed at checkout (e.g., delivery, service, small-order, bag fees, tips).
- Availability, pricing, item descriptions, and preparation times are provided by Third-Party Providers and may change.
- We may present estimated times; estimates are not guarantees.
Payment processing
- Payments may be processed by a third-party payment processor (for example, Stripe) and/or platform wallets (Apple Pay / Google Pay) where available.
- In some cases, Roll & Dine may facilitate payment as a limited payment collection agent for the Third-Party Provider. Payment to Roll & Dine in that role is treated as payment to the Third-Party Provider.
- Your card statement may show a charge from Roll & Dine even if the Third-Party Provider is the seller; your receipt should identify the merchant.
Fraud prevention
We and/or our payment processors may use automated systems to detect and prevent fraud and may block or reverse transactions that appear suspicious or violate these Terms.
Cancellations, order issues, and refunds
Because orders involve time-sensitive food preparation and fulfillment by independent Third-Party Providers, cancellations and refunds are handled on a
case-by-case basis. Refund outcomes may be
full,
partial, or
no refund, depending on the circumstances, including which party is responsible (e.g., kitchen/provider, delivery/courier, or customer).
Cancellations

Before acceptance/preparation: You may request cancellation through the Services. If the order has not been accepted or preparation has not started, cancellation may be approved and may be eligible for a full or partial refund.

After acceptance/preparation begins: If the kitchen/provider has accepted the order or started preparation, cancellation may be declined or may result in a partial refund or no refund.

After pickup / out for delivery: If the order has been handed off for delivery or fulfillment is in progress, cancellation is generally not possible, and charges may remain payable.
Order problems (missing/incorrect/damaged/late/not delivered)
If you experience an issue with an order, you must notify us
promptly through in-app support (where available) or by emailing
admin@rollndine.com. We may request information to investigate (for example, order details, photos, or a short description).
How refund decisions are made
Refund decisions are determined by Roll & Dine
in its reasonable discretion after reviewing available information, including input from the kitchen/provider and, where applicable, the delivery/courier.

Kitchen/provider responsibility: Issues such as missing items, incorrect items, unacceptable quality, or failure to prepare the order as confirmed may result in a full or partial refund and/or other resolution.

Delivery/courier responsibility: Issues such as non-delivery, delivery to the wrong address (where the provided address was correct), or confirmed mishandling may result in a full or partial refund and/or other resolution.

Customer responsibility: Issues caused by incorrect delivery details provided by you, failure to receive the order at drop-off (where applicable), or misuse of the Services may result in no refund or a reduced refund.
Types of resolutions
Depending on the circumstances and applicable law, a resolution may include one or more of the following:
- a full refund,
- a partial refund,
- no refund,
- a replacement/redelivery (where available), and/or
- account credit or promotional credit (where permitted and appropriate).
Refund method and timing

Approved refunds are typically issued back to the original payment method where possible. In some cases, we may offer credit as the resolution (for example, where the original method cannot be refunded or where you agree to accept credit).

Processing times depend on the payment method and payment processor/bank and may take several business days to appear.
Disputes and chargebacks

If you believe a charge is incorrect, contact us first so we can review it. Initiating a chargeback or payment dispute without contacting us may delay resolution.

We reserve the right to suspend or restrict accounts that repeatedly request refunds without valid basis, engage in suspected fraud, or abuse the refund process, consistent with applicable law.
Consumer rights: Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be excluded or waived.
Food safety, allergens, and assumption of risk
Consuming prepared food involves inherent risks, including foodborne illness and allergic reactions. Third-Party Providers are responsible for ingredient disclosures, food preparation, packaging, and compliance with applicable standards.
- Allergens: you are responsible for reviewing menu information and communicating allergies to the Third-Party Provider. We cannot guarantee any item is allergen-free.
- Handling and storage: you are responsible for safe handling and storage of delivered food after receipt.
To the fullest extent permitted by law, you agree that your purchase and consumption of items through the Services is at your own risk, and you release Roll & Dine from claims relating to food quality, ingredients, preparation, or consumption. Nothing in these Terms limits rights that cannot be excluded under applicable consumer protection laws.
User content (reviews, photos, messages)
The Services may allow you to post content such as reviews, ratings, photos, display names, and messages (“User Content”). You are responsible for your User Content and for ensuring you have the rights to post it. By posting User Content, you grant Roll & Dine a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating, marketing, and improving the Services.
Acceptable use
You agree to use the Services lawfully and respectfully. You agree that you will not:
- Violate any law, regulation, or third-party right (including intellectual property or privacy rights).
- Impersonate others, misrepresent affiliations, or create fraudulent accounts.
- Harass, threaten, defame, or discriminate against others.
- Post “objectionable content” (including hate, harassment, explicit sexual content, threats, or violence) or otherwise abusive content.
- Post personal payment info, or solicit sensitive personal information from others.
- Send spam, promotional links, or unauthorized commercial solicitations.
- Attempt to interfere with or disrupt the Services, including probing, scanning, or testing vulnerabilities.
- Use bots, scrapers, crawlers, or data-mining tools to access or extract data without written permission.
- Upload malware, viruses, or malicious code.
- Reverse engineer, decompile, or attempt to derive source code except where permitted by law.
We may remove content and/or suspend or terminate accounts that violate these Terms, our community guidelines, or applicable law.
Reporting and enforcement
If you see suspicious activity, unsafe behavior, or content that violates these Terms, you can report it through the Services (where available) or by emailing
admin@rollndine.com. We may investigate, remove content, restrict features, suspend, or terminate accounts in our discretion, consistent with applicable law.
Intellectual property
The Services, including text, graphics, logos, designs, software, and other materials (“Our Content”), are owned by Roll & Dine and/or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
Third-party services and links
The Services may include third-party services (e.g., payment processors, map providers) and links to third-party websites. We do not control and are not responsible for third-party services, content, or policies.
No background checks; no guarantee of Third-Party Providers
Roll & Dine does not routinely conduct criminal background checks or comprehensive identity verification on all users or Third-Party Providers. You are responsible for using your best judgment when interacting with others. Where we offer optional verification features, they are not guarantees.
Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Roll & Dine disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, Roll & Dine and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses arising from or related to your use of the Services. To the fullest extent permitted by law, Roll & Dine’s total liability for all claims relating to the Services will not exceed the amount you paid to Roll & Dine through the Services in the
3 months before the event giving rise to the claim, or
CAD $100 if you paid nothing (whichever is greater), unless a different minimum is required by law.
Indemnity
You agree to defend, indemnify, and hold harmless Roll & Dine and its affiliates, officers, directors, employees, and agents from and against claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services, (b) your User Content, or (c) your violation of these Terms or applicable law.
Termination
- You may delete your account in-app (where available) or by contacting us.
- We may suspend or terminate your access at any time if you violate these Terms, misuse the Services, or pose security or legal risk.
- Sections that by their nature should survive termination (e.g., licenses, disclaimers, limitation of liability, dispute resolution) will survive.
Governing law
These Terms are governed by the laws of the
Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules, except where consumer protection laws require otherwise.
Arbitration (British Columbia)
Except for claims seeking injunctive or equitable relief to protect intellectual property or confidential information, any dispute arising out of or relating to these Terms or the Services will be resolved by
binding arbitration on an individual basis in British Columbia, Canada, in accordance with applicable arbitration rules in effect at the time.
- No class actions: disputes will be arbitrated only on an individual basis, not consolidated or brought as a class or representative action, to the fullest extent permitted by law.
- Confidentiality: arbitration proceedings and related information will be treated as confidential to the extent permitted by law.
- Costs: each party bears its own legal fees unless the arbitrator awards otherwise under applicable law.
Miscellaneous
- Entire agreement: these Terms, together with referenced policies, form the entire agreement between you and Roll & Dine regarding the Services.
- Severability: if any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver: failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale.
